GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. GMC Canyon, Chevy Colorado diesels finally heading to dealers

Customers who have been waiting to receive their diesel-powered Chevrolet Colorados and GMC Canyons should be relived to hear that GM will finally start to ship them out of the Wentzville Assembly Plant. "The highly anticipated 2016 GMC Canyon diesel has begun shipping to dealers," a company spokesperson confirmed to The Detroit News. The trucks originally had a fall launch date, but a final review forced a delay in deliveries. The 2.8-liter four-cylinder diesel in the midsize trucks produces 181 horsepower and 369 pound-feet of torque, and the company touts the engine's low emissions. The Environmental Protection Agency and California Air Resources Board even put the mill through extra scrutiny with a real world test in the wake of VW's diesel scandal, and the Duramax passed with no problems. At that time, a Chevy spokesperson told Autoblog that the models' launch was on track. The Duramax engine adds $3,730 to the price of a comparable V6 model, but they're the most fuel-efficient pickups on the market. The EPA estimates the twins at 31 miles per gallon highway, 22 mpg city, and 25 mpg combined in two-wheel drive form and 29/20/23 with four-wheel drive. Buyers likely can't wait to finally experience these pickups after reading a heap of positive reviews. The Colorado diesel recently earned Motor Trend's Truck of the Year award. 2022 Chevrolet Silverado LT Trail Boss adds 3.0-liter diesel option

Order books just opened for the 2022 Chevrolet Silverado, which, in case you hadn't heard, is almost unchanged compared to the 2021 Silverado. The overhauled Silverado and GMC Sierra that we caught in spy shots several times last year and were expected to launch this year have been delayed. Until that pickup gets here, Chevrolet and GMC will add "Limited" to the names of the Silverado and Sierra. Fleet guides for next year's truck show the official model name as Chevrolet Silverado 1500 LTD. There are a few interesting features coming next year, though, like the Multi-Flex tailgate joining the options list for Silverado HD trucks. GM Authority also reports that the 2022 Silverado LT Trail Boss adds the 3.0-liter oil-burner with 277 horsepower and 460 pound-feet of torque as a third engine option, which should be a big treat for the off-roading crew. Whereas the GMC Sierra AT4 already offers the 3.0-liter diesel, the Silverado LT Trail Boss only offers the 5.3-liter and 6.2-liter V8s, both bolted to GM's ten-speed automatic transmission. Then there's the Custom Trail Boss that adds the 4.3-liter V6 as an option, and it and the 5.3-liter V8 only get 6-speed automatics. At the moment, Silverado trims that offer the Duramax charge a $1,045 for it over the 5.3-liter V8. If that gap holds true for next year, the diesel will just about evenly split the price difference between the LT Trail Boss with the 5.3 and the 6.2.   Elsewhere in the range, Driving.ca said Canadian fleet guides show the 4.3-liter V6 and lower-spec 5.3-liter V8 with Active Fuel Management (AFM) instead of Dynamic Fuel Management (DFM) disappearing from next year's base Silverado WT. To clarify, AFM only shuts off half the cylinders in certain conditions, whereas DFM constantly adjusts how many cylinders are firing all the time. As it stands, that would leave the 2.7-liter turbo four-cylinder as the only engine option. However, those other two mills were the only ones left in the lineup that shift through a six-speed transmission, making it possible that they'll rejoin the options list with at least two more gears to choose from. It's not clear if GM will sell the Limited models alongside the majorly upgraded 2022 Silverado. The automaker did just that a few years ago, selling the previous-gen truck as a Limited trim alongside the then-new, current-gen. It certainly wouldn't be the only company to do so, either.
