GM does not have to turn over its ignition switch documents

In June the lawyer representing plaintiffs suing General Motors over faulty ignition switches accused GM and its firm King & Spalding of working together to cover up the malfunction. Bob Hilliard said that certain communication between GM and King & Spalding from 2010 to 2013, mainly focused on three Chevrolet Cobalt crashes, would reveal that they conspired in "burying what they knew" concerning the defect, and furthermore that the law firm broke rules of professional conduct once it found out about "ongoing fraudulent concealment" at GM. Hilliard filed a motion in a Manhattan court to force GM and King to hand over the memos, which were protected by attorney-client privilege. Hilliard said that the alleged ongoing fraud should trump attorney-client privilege, a GM spokesman said at the time that the issues in question had already been discussed previously, and that plantiffs already had much of the communication Hilliard's motion sought. US District Judge Jesse Furman ruled in favor of GM and King, refusing to order the release of the communication. In spite of finding probable cause that GM was engaging in a crime or fraud by not revealing the ignition switch defect, Furman did not find cause to believe that GM and King's discussions at the time were centered around continuing that potential crime or fraud. Saying also that plantiffs already had many of the disputed documents, attorney-client privilege should hold sway over the remainder. The class action case goes to trial in January 2016.

GM recalls nearly 1 million vehicles for airbag defect

WASHINGTON — General Motors said on Friday it will recall nearly 1 million sport utility vehicles in the United States because the driver's airbag inflator may explode during deployment. The recall covers 994,763 Buick Enclave, Chevrolet Traverse, and GMC Acadia vehicles from the 2014 through 2017 model years with modules produced by ARC Automotive Inc. Dealers will replace the driver's airbag module. The National Highway Traffic Safety Administration said a driver in Michigan of a 2017 Chevrolet Traverse was in a crash in which the front-driver airbag inflator ruptured during deployment causing facial injuries. An April 25 inspection confirmed that the front driver airbag inflator ruptured in the vehicle. The National Highway Traffic Safety Administration (NHTSA) demanded the recall of 67 million air bag inflators because it believes there is a safety defect, but auto supplier ARC Automotive Inc rejected the U.S. regulator's request, documents released on Friday show. The auto safety agency said the inflators pose an unreasonable risk of death or injury. Even as ruptures mount, "ARC has not made a defect determination that would require a recall of this population," NHTSA said in its demand letter to the Tennessee-based company. "Air bag inflators that project metal fragments into vehicle occupants, rather than properly inflating the attached air bag, create an unreasonable risk of death and injury." GM said it was still investigating the issue with the assistance of a third-party engineering firm. "GM is taking this expanded field action out of an abundance of caution and with the safety of our customers as our highest priority," the Detroit automaker said. GM said it was aware of two prior ruptures of ARC-manufactured airbag inflators in 2015 Chevrolet Traverse vehicles, and GM conducted two earlier small recalls of about 3,000 ARC inflators. All three rupture events in Chevrolet Traverse vehicles involved the same inflator variant. ARC noted in a letter made public Friday that no root cause for those ruptures has been identified by ARC or GM. GM's Oshawa plant may close after Camaro production moves

Most of the time, when vehicle production is moved from one assembly plant to another, it spells bad news for the former. While General Motors won't go so far as to say its Oshawa, Ontario factory, which is losing the Chevrolet Camaro to the Lansing Grand River plant, is in trouble, analysts seem to think the factory's days are numbered. Forecasts for the facility are far from positive. The loss of the Camaro this year, combined with GM's targeted shutdown of a single-shift assembly line responsible for the fleet-only Chevy Impala Limited and the Equinox crossover is a bad enough omen. But with AutoForecast Solutions CEO Joe McCabe telling The Detroit News that the plant's other two products, the Cadillac XTS and Buick Regal, aren't likely to stick around beyond 2017, things look decidedly grim at Oshawa. "There is a fairly strong chance that the plant could close," Jeff Schuster, senior VP of forecasting for LMC Automotive, told The Detroit News. That doesn't mean that Unifor, Canada's auto union, and the Canadian government are going to let the factory die without a fight. And with the latter chipping in $10 billion as part of GM's 2009 bailout, you might think it has a degree of leverage in the situation. A meeting between the government and the Detroit Three at the 2015 North American International Auto Show revealed that Oshawa is already a topic of conversation. "We made it very clear that we would like to see an indication on the future of Oshawa sooner, in particular because the timing is very challenging for our supply chain to be able to adjust to potentially future orders or changes, but also to know that there are going to be future opportunities at Oshawa," Ontario's Minister of Economic, Development, Employment and Infrastructure Brad Duguid told The Detroit News. "Bottom line: It's time they made a longer-term commitment here," Unifor President Jerry Dias said, echoing Duguid's statements. It's unclear if this sort of strong talk will be enough to save 3,300-plus employees, although based on the analysts' forecasts, we doubt it.
