GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. 2022 Chevy Suburban, Tahoe, GMC Yukon, Cadillac Escalade up another $1,600

The 2022 Chevrolet Tahoe and Suburban, the 2022 GMC Yukon and the 2022 Cadillac Escalade have all gone up by $1,600. The GM profit and loss department added $1,500 to the MSRP for each of the full-sized SUVs and $100 to their destination charges, that destination fee now $1,795 for each vehicle. It's not an inconsequential bump; however, considering where the trucks were priced at launch, and everything that's happened since, the latest retail prices don't seem that bad. Take the Suburban — in February 2020, Chevrolet practically carried over pricing for the truck with a revamped interior and independent rear suspension, starting it at $50,295 after destination. After this latest increase, the 2022 Tahoe LS in two-wheel drive costs $55,590, after destination.  The delta between the 2021 Suburban at launch in March 2020 and the current model is a little grander compared to the Tahoe, like the SUV itself. Back then, it started at $52,295, the same price as the outgoing model. After this third price increase in the past year, the 2022 Suburban LS in 2WD starts at $61,290 after destination. GM Authority says the 2023 Tahoe and Suburban are reportedly headed down production lines in the middle of July. The biggest addition to both models will be the availability of Super Cruise, which is already available on the sister SUV, the Cadillac Escalade. The hands-free driving assistance feature can only be optioned on the Premier and High Country trims. It costs $2,500 to put Super Cruise on the Escalade. GM hasn't divulged the feature's price yet for the Chevy twins; that's likely to come when the automaker announces 2023 Tahoe and Suburban MSRPs, so beware of more potential price increases. After that, there's a heavy refresh planned for the 2024 model year, including a new instrument panel design that looks like it replaces the current gauge cluster with a large, freestanding screen.  The Yukon's entry-level price goes up to $57,590 for the SLE trim turning the rear axle.   The Cadillac Escalade's second MSRP bump takes it to $81,235 for the Luxury 600 trim in 2WD, and $84,235 for the extended ESV model in the same trim. The price creep hasn't stopped Escalades from pulling off dealer lots almost as soon as they're delivered, sales for the first quarter of the year totaling 10,505 units, trouncing domestic and foreign competition. Next-gen Chevy Volt will get 1.5-liter, four-cylinder engine

As General Motors gets ready to unveil the new Chevy Volt at the Detroit Auto Show in January, it's starting to reveal a few more details about the updated plug-in hybrid. Today should be fruitful on that front, thanks to an event GM is hosting today that focuses on the new Volt, and we've just had the first bit of new: a bigger engine is coming. Since the beginning, the Volt has used a 1.4-liter, four-cylinder engine as a range extender when the battery runs dry. The second-generation model will instead get a slightly larger 1.5-liter, four-cylinder engine that will be built in Flint, MI. That's a step up from the various engines that have been a part of the 2016 Volt's rumored mills, everything from a 1.0-liter or 1.2-liter three-cylinder to a 2.0-liter turbo. The confirmation about the new 1.5-liter powerplant was found in Automotive News, where we also heard again that GM is going to start building the new Volt's electric drive unit in Detroit, moving production up from Mexico.
