GM faces possible class action lawsuit over 8-speed transmission

General Motors has been hit with a class-action lawsuit from owners who allege the eight-speed automatic transmission found in several rear-wheel-drive Chevrolet, Cadillac and GMC models between the 2015 and 2019 model years has a defect that causes the vehicles to hesitate and jerk when accelerating or slowing down. The lawsuit was posted to ClassAction.org and spotted by GM Authority. Problems with GM's Hydra-Matic 8L90 and 8L45 transmissions have been well-documented on Internet forums and via complaints filed with the National Highway Traffic Safety Administration, with many reporting damage to their vehicles. The lawsuit was first filed in December in U.S. District Court for the Southern District of Florida but appears to have been transferred recently to New York. Autoblog sought comment from Theodore Leopold, the lead attorney for the plaintiffs. "These transmissions have a common defect," the complaint reads. "Drivers attempting to accelerate or decelerate their cars feel a hesitation, followed by a significant shake, shudder, jerk, clunk, or 'hard shift' when the vehicle's automatic transmission changes gears." The problem also occurs when the vehicles accelerate in a single gear, without shifting, the plaintiffs allege. "Drivers have reported that the shift is sometimes so violent, they feel as though they have been hit by another vehicle." The problem is believed to center on the transmission, torque converter or both. The complaint says it causes undue friction, causing hydraulic systems and gears to function improperly and sometimes leaves metal shavings throughout the transmission, leading to costly repairs and replacement of parts or the entire transmission. It says GM has known about the problems since shortly after it introduced the transmissions, and has issued 13 technical service bulletins, none of which have resolved the problem. GM declined to comment on the lawsuit. The plaintiffs say GM should have warned consumers about the issues and covered repairs under each vehicle's three-year/36,000-mile bumper-to-bumper warranty. They're seeking statewide classes in at least six states: California, Florida, Illinois, New York, Oklahoma and Texas.

So, if that's all correct, then it would make sense that confirmation of this plan would come at the 2015 Detroit Auto Show, which is just around the corner. And lookee here... The Wall Street Journal is reporting that GM will unveil a concept Chevy Bolt at the Detroit show on Monday. That name sure makes sense, too, since GM registered that trademark back in August. According to the Journal, the rumored numbers – 200-mile range, $30,000 price – are still what's expected. Some new purported details are that the battery will come from LG Chem, which also makes the Volt's batteries, and that the Bolt will be a crossover that could be sold around the world. This all smacks of a preemptive strike against the Tesla Model 3, which is also due around 2017. Currently, GM sells the Spark EV in limited areas of the US, despite a lot of excitement for wider availability. To sell a 200-mile EV for $30,000 means that GM and LG Chem will likely have drastically reduced the cost of making a big plug-in vehicle battery. It's been that way for years — the Ford F-Series has been America's best-selling vehicle for 38 consecutive years — and it's not going to change any time soon. Buyers are averaging nearly 13% off the cost of the 2019 Ram, paying an average transaction cost of $41,667. That's $6,071 off the average retail price, which equals the best truck deal in October. The 2020 edition isn't discounted nearly as far, averaging $2,852 off for an average transaction price of $48,904. The next best deal is on the 2019 Ford F-150; its average transaction price of $43,064 equals $3,843 off its sticker price. The 2020 F-150's $2,810 discount means buyers are paying around $47,300. They should know, though, that a brand-new model is coming for 2021, so we'd expect bigger discounts on remaining 2020 inventory in the coming months. Moving to General Motors, the best deal you'll find is on leftover 2019 Chevy Silverado 1500s, which are selling for an average of $47,043. That's $2,852 off the sticker price. Interestingly, 2020 Silverados are seeing slightly lower transaction prices at $46,009, but with a smaller average discount of $1,693. The 2020 GMC Sierra is mechanically similar to the Chevy, but aimed at buyers who want a bit more luxury. That's reflected in the 2020 Sierra 1500's average transaction price of $54,491, which is $2,131 off its sticker.
