GM faces possible class action lawsuit over 8-speed transmission

General Motors has been hit with a class-action lawsuit from owners who allege the eight-speed automatic transmission found in several rear-wheel-drive Chevrolet, Cadillac and GMC models between the 2015 and 2019 model years has a defect that causes the vehicles to hesitate and jerk when accelerating or slowing down. The lawsuit was posted to ClassAction.org and spotted by GM Authority. Problems with GM's Hydra-Matic 8L90 and 8L45 transmissions have been well-documented on Internet forums and via complaints filed with the National Highway Traffic Safety Administration, with many reporting damage to their vehicles. The lawsuit was first filed in December in U.S. District Court for the Southern District of Florida but appears to have been transferred recently to New York. Autoblog sought comment from Theodore Leopold, the lead attorney for the plaintiffs. "These transmissions have a common defect," the complaint reads. "Drivers attempting to accelerate or decelerate their cars feel a hesitation, followed by a significant shake, shudder, jerk, clunk, or 'hard shift' when the vehicle's automatic transmission changes gears." The problem also occurs when the vehicles accelerate in a single gear, without shifting, the plaintiffs allege. "Drivers have reported that the shift is sometimes so violent, they feel as though they have been hit by another vehicle." The problem is believed to center on the transmission, torque converter or both. The complaint says it causes undue friction, causing hydraulic systems and gears to function improperly and sometimes leaves metal shavings throughout the transmission, leading to costly repairs and replacement of parts or the entire transmission. It says GM has known about the problems since shortly after it introduced the transmissions, and has issued 13 technical service bulletins, none of which have resolved the problem. GM declined to comment on the lawsuit. The plaintiffs say GM should have warned consumers about the issues and covered repairs under each vehicle's three-year/36,000-mile bumper-to-bumper warranty. They're seeking statewide classes in at least six states: California, Florida, Illinois, New York, Oklahoma and Texas.

Kurt Busch suspended indefinitely after losing appeal

NASCAR has officially suspended Kurt Busch indefinitely after he was found in violation of two specific clauses in the stock racing rulebook, specifically "Actions detrimental to stock car racing" and a "Behavioral Penalty." Earlier in the week, the State of Delaware issued an Order of Protection from Abuse against him after a case detailing alleged domestic violence committed by Busch against his girlfriend, Patricia Driscoll, reached its conclusion. Busch and his legal team have exhausted all of their appeals options, meaning the indefinite suspension is official and final. Busch will not take part in the Daytona 500, which kicks off the 2015 NASCAR season today. Regan Smith will drive the No. 41 Stewart-Haas Chevrolet today at Daytona. It's not yet clear if Busch will face criminal charges over the domestic abuse incident. A Commissioner for Kent County in Delaware found that a "preponderance of evidence" led him to conclude that Busch did indeed commit "an act of domestic violence" against Driscoll, but that is a separate matter from the police investigation into the incident that is now in the hands of the office of the attorney general. Next Chevrolet Malibu to have 'groundbreaking,' 'passionate' design

In our First Drive of the Chevrolet Malibu after its redesign in 2013 we wrote, "Chevy has quickly worked up a host of changes for its ever-important midsize sedan, and will be launching this 'there, we fixed it' 2014 Malibu like it's an all-new product." Still, no one cared. The Malibu has been mentioned in eight posts this year, all but two of them dealt with recalls, and one of those two was about a 2011 Malibu university science project. It came up in precisely zero posts from November 2013 to March 2014. That's why, according to a report in Automotive News, Chevrolet honchos are "hustling" to have a new Malibu ready in a year. Mark Reuss, General Motors' head of global product development, said it will have "groundbreaking design" and "groundbreaking technology," and asked investors who were showed a picture of it, "When is the last time you saw a [midsize] car this distinctive and this dramatic from General Motors?" Doubling down on the bullishness, Reuss said, "We've got our act together here on the midsize-car segment." Then, throwing every last chip on the pile, global design head Ed Welburn said the next Malibu's design will "make a significant statement" with "a very passionate design." Based on the number of comments Malibu posts get, we figure a fair few number of you would love for this to be the case; yet this is a lot of braggadocio to slather on a car that probably hasn't made "a significant statement" since Elton John had a number one record with Honky Chateau. That was 1972, if you're trying to remember. No matter the looks, the AN report says the new 'Bu will make a profit statement, selling for more money while costing less to produce. Alongside the Cruze, GM figures the pair will bring in an extra $800 million in variable profit in 2016. Which, in case it ends up being another 'butterface,' isn't bad for a silver lining.
