GM won't pay owners of recalled cars for lost value
Thu, 12 Jun 2014Kenneth Feinberg, the man in charge of the General Motors compensation fund dealing with the its widespread ignition switch woes, has issued an informal, two-letter response to the plaintiffs in more than 70 lawsuits seeking redress for lost resale value of their Cobalts: "No." The cases were recently combined into one, but Feinberg told The Detroit News that the fund will deal "only with death and physical injury claims," and that "perceived diminished value" will get no consideration.
ALG, the firm specializing in establishing residual values, determined that Cobalt owners had lost $300 compared to the segment competition and doesn't envision any long-term effects from the recall situation. Feinberg's statement comes in advance of public details on how the compensation fund will work and adheres to GM's long-held position on the matter. The company has already asked a judge to throw out such suits using the pre-bankruptcy defense, even as it stopped using that defense in cases of injury and death.
With plenty of potential gain from the GM suit, however, don't expect the plaintiffs to give up yet. When Toyota was sued for the same reason during the unintended acceleration debacle, it eventually settled the case for between $1 billion and $1.4 billion just to get it over with. Since the 85 law firms involved in the Toyota litigation took home more than $250 million of that total, we shouldn't expect the attorneys to give up on a GM payout, either.
GM recalls nearly 340,000 large SUVs to fix daytime running lights
Thu, Nov 10 2022General Motors has initiated a recall campaign for more than 338,000 of its large SUVs to address a potential defect in the onboard computer software that controls the daytime running lights. In some cases, the DRLs may remain on even when the headlights are enabled, which creates additional glare for oncoming drivers at night and fails to comply with federal regulations for headlight performance. "GM determined that the body control module (BCM) software in these vehicles, under a combination of certain pre-conditions, may fail to deactivate the DRLs when the headlamps are on," GM's recall report said. "A regulatory assessment was conducted to evaluate whether the condition presented a potential noncompliance with the DRL activation requirements in S7.10.5, Table I-a. of FMVSS 108. On October 27, 2022, GM’s Safety Field Action Decision Authority (SFADA) decided to conduct a recall for potential noncompliance with this standard." GM says the recall covers the 2021 model year GMC Yukon and Yukon XL, 2021 Chevrolet Tahoe and Suburban, and 2021 Cadillac Escalade and Escalade ESV. The company says all models produced within that operating window include the improperly programmed body control module, meaning all vehicles within the recall population may exhibit the problem. The issue was discovered by a GM engineer during validation testing in August, prompting a deeper investigation and eventually leading to the recall itself.  The module's software can be updated by GM dealers, so it should be a quick fix for customers. Sun, Dec 14 2014Now there's an attention-grabbing headline, eh? Although the answer to the riddle - pickup trucks and SUVs - might be somehow deflating, the numbers involved deserve a going over. According to TrueCar's figures (click on the table to enlarge), six of the year's ten best-selling vehicles in the US that sell for a transaction price above $50,000 are body-on-frame, and the Mercedes-Benz E-Class is the only foreigner to crack the top five. Every enthusiast knows that pickup trucks are 'Murica's most popular vehicle by a colossal margin, and there have been plenty of reports about the popularity of luxuriously appointed trucks and SUVs, but compare these figures from TrueCar: 70 percent of Chevrolet Tahoe sales have a transaction price above $50K, and The Bowtie is expected to make $3.9 billion in revenue on 66,945 predicted high-dollar sales; 95.1 percent of E-Class sales break $50K, so the German company will make $4.0 billion on 67,006 predicted sales in that pricing sphere. It's about the only time you'll see the Tahoe ranked right next to Mercedes' bread-and-butter sedan. Ram is ahead of those two with $4.2B coming from $50K-plus sales. The Ford F-Series does almost as much revenue as the next three combined, with an expected $10.8 billion coming from sales of trucks over $50K - more than a quarter of the model's total sales, when a base F-150 can be had for about $26,000. Yes, the Germans make a lot more money on fewer sales, but considering the comparison, the bottom line isn't too troubled by such facts. Weighing like-for-like, the full-size Ford walks it in every category; elsewhere, the Chevrolet Silverado outsells the Ram, but the Ram outsells the Chevy by 6.7 percent above $50K. And for all the flak GMC takes over swapping out grilles, the Sierra also outsells the Chevy in the well-appointed segment, 16.1 percent of sales versus 11 percent – the Professional Grade brand is a huge profit center for The General.
