GM does not have to turn over its ignition switch documents

In June the lawyer representing plaintiffs suing General Motors over faulty ignition switches accused GM and its firm King & Spalding of working together to cover up the malfunction. Bob Hilliard said that certain communication between GM and King & Spalding from 2010 to 2013, mainly focused on three Chevrolet Cobalt crashes, would reveal that they conspired in "burying what they knew" concerning the defect, and furthermore that the law firm broke rules of professional conduct once it found out about "ongoing fraudulent concealment" at GM. Hilliard filed a motion in a Manhattan court to force GM and King to hand over the memos, which were protected by attorney-client privilege. Hilliard said that the alleged ongoing fraud should trump attorney-client privilege, a GM spokesman said at the time that the issues in question had already been discussed previously, and that plantiffs already had much of the communication Hilliard's motion sought. US District Judge Jesse Furman ruled in favor of GM and King, refusing to order the release of the communication. In spite of finding probable cause that GM was engaging in a crime or fraud by not revealing the ignition switch defect, Furman did not find cause to believe that GM and King's discussions at the time were centered around continuing that potential crime or fraud. Saying also that plantiffs already had many of the disputed documents, attorney-client privilege should hold sway over the remainder. The class action case goes to trial in January 2016.

GM follows up Lambda CUV stop-sale with tire recall

In late January, General Motors announced a stop-sale for about 6,281 examples of the 2015 Chevrolet Traverse, GMC Acadia and Buick Enclave because of the possibility for the treads cracking on their 18-inch Goodyear Fortera HL tires. At the time, GM said that this would also eventually lead to a safety campaign to repair the problem, and the National Highway Traffic Safety Administration has just published those details. GM's recall covers 5,876 of the three Lambda platform crossovers to replace their tires. According to NHTSA, if the treads crack, there could be a loss of pressure and possible failure. Goodyear already announced its own recall of the tires after internal testing found small tread cracks. The company did not believe this was safety issue, but the problem did put the rubber out of compliance with federal laws. The business's safety campaign covered an estimated 48,512 tires. Of those, around 32,000 were reportedly made for GM to either be fitted to vehicles or sold as replacements. The remainder went to the aftermarket. Goodyear's portion of the recall is expected to begin around February 20. Worldwide, Nissan Leaf has outsold next two competitors combined

Nissan may not be meeting some of the more optimistic prognostications with sales of its Leaf electric vehicle, but it's certainly kicking the competition's butt. EV Sales is tracking global sales of plug-in vehicle models and estimates that Nissan has sold almost 172,000 units of the Leaf worldwide. That's more than the two next-best-selling plug-ins combined. Globally, EV Sales estimates, the Chevrolet Volt extended-range plug-in has moved about 88,000 units, while Toyota has sold about 71,000 of its Prius Plug-in Hybrid vehicles worldwide. Fourth-place Tesla Model S is close behind at about 66,000 units. Among automakers, Nissan is also by far the lead dog, but Mitsubishi has leapfrogged Chevrolet among plug-in vehicle makers, as the Outlander Plug-in Hybrid continues to sell well. Impressively, the relatively new BMW i3 has moved almost 23,000 units since its debut in Germany last year. As for Nissan, company chief Carlos Ghosn said at the New York Auto Show earlier this month that the company could sell as many as 50,000 units a year of the Leaf in the US, provided that charging infrastructure throughout the country improves. Earlier this year, cumulative US Leaf sales moved past 75,000 units since its late-2010 launch.
