GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. The Chevrolet Volt has been awarded Kelley Blue Book's Electric/Hybrid Car Best Buy for 2015. KBB cited the car's electric commuter capabilities, extended range, acceleration, design and overall value as reasons to place it above the Nissan Leaf, BMW i3 and Toyota Prius. The BMW i3 is seeing slow sales in Germany. BMW has sold about half the number of i3s it expected in its home country, with about 1,900 sold in the first nine months. BMW projected sales of 5,000 to 6,000 in the first year. BMW partly blames long shipping times for the slow sales, and the company is offering incentives in hopes of getting more people to adopt the electric car. Audi is pursuing new carbon-neutral synthetic fuels - or e-fuels - such as Audi e-diesel. Audi's newest project uses electrolysis of water to create hydrogen, which it then reacts with CO2 extracted from the air. The result is a liquid - called Blue Crude - full of energy from hydrocarbon compounds. The Blue Crude can then be converted into a sulfur-free synthetic diesel called e-diesel. Uber is partnering with Spotify to allow passengers to choose what music they listen to during their ride. Users will be able to choose their own playlist that will be ready and playing for them when they are picked up. It offers a more personalized experience from the ride-hailing service, which, according to Uber CEO Travis Kalanick, is "nirvana" for music lovers. Paying Spotify users will be able to use the feature initially in London, Los Angeles, Mexico City, Nashville, New York, San Francisco, Singapore, Stockholm, Sydney and Toronto. GM 6.2L V8 claims most powerful light-duty truck engine title

General Motors has officially captured the horsepower crown for mainstream pickup trucks with its 6.2-liter V8. The big mill, available in both the Chevrolet Silverado and GMC Sierra, comes to market with 420 horsepower and 460 pound-feet of torque, handily outdoing its two cross-town competitors, Ram (5.7-liter V8, 395 ponies and 407 lb-ft) and Ford (6.2-liter V8, 411 hp and 434 lb-ft).
The new GM 6.2 will take a bit of an investment, though. Those that want the extra thrust will need to go with either the LTZ or High Country trims from the Chevy, or the SLT and Denali trims from GMC, which are the two highest trim levels for the respective vehicles. Trim levels aside, if you're in the business of towing, GM has you covered. Optioned with the 6.2-liter V8 and the Max Trailering Package, owners will be able to pull 12,000 pounds, a hugely impressive figure.
We still aren't certain as to what sort of economy the new engine will get, but it'll probably be a bad bet for the fuel conscious. As for availability, expect to see the 6.2-liter trucks in showrooms later in the fall.
