GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. You get a ton of features for the money as well as a very generous warranty. Holding it back is its rather weak engine and very tiny proportions. It seems as though there's a great pick for nearly every taste, whether you're seeking something sporty, rugged or luxurious. They're a great pick for small families with one child and/or a dog. The class is led by vehicles that include the Honda CR-V, Kia Sportage and Mazda CX-50, which are still within reach of most shoppers' budgets. 2024 Chevrolet Equinox: $27,995 The Equinox debuted back in 2005 and this current third-generation was last redesigned in 2018, though a new one is right around the corner for the 2025 model year. While the current 2024 model may be showing its age, it still deserves your consideration for its comfortable ride quality, confident cornering and roomy passenger space.

2016 Chevy Volt auctioned off to help the robots

One of the cool things about the 2016 Chevrolet Volt extended-range plug-in being auctioned off to raise money for kids' science and robotics program is that even the sedan's color sounds very scientific. Indeed, it's fitting that a "Kinetic Blue" Volt will be used to advance the scientific education of the country's students, according to Hybrid Cars. That is, if it fetches enough cash. Chevrolet parent General Motors was kind enough to donate a 2016 Volt to the so-called FIRST K-12 robotics program (FIRST stands for For Inspiration and Recognition of Science and Technology). The program was founded in 1989. Last year, General Motors engineers worked with about 10,000 FIRST students in the US, but it looks like GM is now going the cold-hard-cash route to make its mark on future scientists. Bidding for the vehicle will take place until the morning of November 19, and, hopefully, it will generate enough interest to drive the bidding price up beyond its MSRP. As of Tuesday morning, nine bids had been taken, with the top one at $27,750. That's all fine and good except the car is pretty loaded with bells and whistles, and it's 53-mile electric-only range is a considerable jump from the first-generation Volt, so the car's "estimated value" is $40,245 (not factoring in the $7,500 federal tax incentive). That's a pretty good jump over the 2016 Volt's base price of $33,995, which marked a $175 price cut from the 2015 model. So pony up, folks. It's for the kids. Related Video:
