GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Now, there are certainly some models that are smaller (Nissan Rogue Sport) or larger (Kia Sorento) that could also be considered, but we figured it was wise to stick with those in this sweet spot of comparable size and price. Sometimes it's turbocharged, often its not, but standard engine outputs are generally in the same ballpark. Therefore, we'd recommend focusing on torque output, as it's what will make a difference around town or when passing, and weighing that versus fuel economy (the Chevy Equinox, GMC Terrain, Honda CR-V and Mazda CX-5 make particularly strong cases in this regard). Many drivers aren't too fond of continuously variable transmissions (CVT), either, so that's another thing to consider and note during a test drive. As you can see, several models are available with performance upgrades. Besides the Jeep Cherokee's available V6, all are more powerful turbocharged four-cylinder engines. The exception to this would be the Honda CR-V and Ford Escape, as their 1.5-liter turbo engines don't prioritize performance. Instead, they serve as overall upgrades to the base naturally aspirated engines standard on only their base trim levels (CR-V LX and Escape S).

Chevy Volt, Nissan Leaf sales show big drops in September

As most readers likely know, it's not just lower gas prices that are affecting plug-in vehicle sales. The two long-time sales leaders in the US - the Nissan Leaf and the Chevy Volt - are getting long in the tooth. First introduced in late 2010, the vehicles have been updated here and there since then, but recent sales figures have been lagging behind where they were in 2014. This trend continued in September, with sales of both vehicles down in a big way compared to last year. Sales of Nissan Leaf totaled 1,247 for the month of September. This is down a whopping 56.7 percent from September 2014, but thankfully the year-to-date sales are not quite as negative. So far this year, Nissan has sold 13,630 Leafs, which is "just" 37.5 percent lower tan the YTD total at this point in 2014 (21,822). This decrease swims against the overall direction of Nissan's September sales, which were up 18 percent over last year and set a new September record. The Volt sold 949 units last month, down 31.9 percent from last September. Year to date, the Volt has sold 9,264 units, which is 36.3 percent lower than the number of Volts that were sold in the first nine months of 2014 (14,540). This downward trend might be coming to an end soon. The new Chevy Volt will go on sale in 11 US states later this fall, and the 2017 model will be available nationwide next spring. An updated Leaf for the 2016 model year also offers more miles – 107, vs 84 in the 2015 version – so potential customers who have been waiting for the latest and greatest will soon not have any excuses.
