GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. It's time for Corvette to attack Porsche

For most of its existence, Porsche was a smug little sports car company with a fairly limited lineup and small but steady sales. Any time the company strayed from its air-cooled, rear engine formula, the purists would turn their noses. The 944? The 948? "Not a proper Porsche," they'd sniff. And then came the greatest sin of them all: the Cayenne. To the purists, this was treason. Porsche making an SUV? Horrors! Of course, you all know how it turned out. Porsche grew to be a profit-generating juggernaut within the Volkswagen Group. And since one SUV wasn't enough they added another, the Macan. By the end of the decade Porsche will have quadrupled its global sales. You have to wonder what else it has up its sleeve. Couldn't this be a lesson for General Motors? It has a terrific sports car brand in Corvette. In fact, it's arguably the most iconic brand within GM's full-line portfolio. But for its entire existence that brand has been locked up within Chevrolet. Maybe it's time for GM to treat Corvette as a stand-alone company. Maybe it's time for GM to unlock that brand and treat Corvette as a stand-alone company. A Corvette SUV could be a killer first step. Since Porsche only makes two SUVs, maybe Corvette could make three. Small, medium, and large. And just as Porsche has the Panamera, an executive sedan from team Corvette could become an instant "gotta-have" for the yacht-buying jet set. Of course, the Corvette purists will cringe. And the biggest hue and cry will come from Chevrolet's US dealers. That's why the best place to launch the new Corvette brand would be far away from those franchisees: in China. Chinese consumers have no pre-conceived ideas that 'Vettes can only be sold in Chevy stores. And Chinese enthusiasts very much admire Corvette's historic pedigree. You've no doubt read about how Chinese authorities are cracking down on conspicuous consumption. That makes the timing even better. Corvette's selling point has always been that it is an amazing bargain for the performance you get. What a perfect way to undercut Porsche. In fact, pairing the Corvette brand with Cadillac in China could be just the shot in the arm that Cadillac's Chinese dealers need. Despite having very competitive cars, Cadillac lags far behind Audi, Mercedes, and BMW. What Cadillac dealers need is a lot more showroom traffic. And a jaw dropping lineup of Corvette-branded vehicles could bring in throngs of buyers.

Chevrolet Silverado reportedly getting the GMC Sierra's MultiPro tailgate

GMC reinvented the pickup tailgate when it added a six-way option named MultiPro to the current-generation Sierra it introduced in 2019. It kept this clever feature to itself as a way to differentiate the Sierra from the Chevrolet Silverado, but a recent report claims it will begin sharing it in the not-too-distant future. Enthusiast website GM Authority learned from anonymous sources familiar with Chevrolet's product plans that the Silverado will soon receive its own version of the MultiPro tailgate. It will be called either MultiFlex or Multi-Flex, a name Chevrolet has already trademarked, and it was initially scheduled to make its debut for the 2021 model year. Its arrival might be delayed until the 2022 model year due to the coronavirus pandemic, however. Chevrolet's Silverado and GMC's Sierra are nearly identical under the sheet metal, so adding the latter's six-way tailgate to the former will be a relatively straightforward and cost-effective process. Interestingly, GM Authority wrote engineers could add a seventh function to the tailgate, though it didn't reveal what they have in store. It's also not sure whether both trucks will get the new feature, or if it will exclusively be offered on the Chevrolet. 2022 will bring major updates to the Silverado and the Sierra, potentially including — as we've previously reported — an independent rear suspension. Interior upgrades will allegedly be part of the mid-cycle changes, too, but we still don't know if the Silverado will receive the tough carbon fiber cargo box available in the Sierra. In the meantime, motorists in the market for a Sierra will temporarily have fewer options to choose from. GMC has asked its dealers to stop taking orders for the regular- and double-cab variants of the truck, according to a separate report from GM Authority. Putting the slower-selling regular- and double-cab trucks on hiatus will allow dealers to build up their inventory of crew-cabs, which sell far better and are in relatively short supply. These restrictions will remain in effect until the 2021 model year, which starts on September 14 for double- and crew-cab models and on September 21 for regular-cab trucks.
