GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Chevrolet Malibu could last until 2024 before joining the dodo

Automotive News pieced together all available intel on the Chevrolet and GMC lineups, trying to ascertain how much life each model might have left. Concerning the Chevrolet Malibu, the answer is not too much, and the historic nameplate's final years don't look like the glory kind. After a major overhaul in 2016 boosted sales for the ninth-generation sedan to 227,881 units, the 2018 sales fell to 144,542, and this year's are down almost 15% through the end of June. The Malibu is one of two Chevrolet sedans still breathing - the other being the Impala for now - but only for about five more years. AN says there'll likely be a refresh in 2022, followed by a visit from the Reaper in 2024. After that, it could be "indirectly replaced" by an electric vehicle, one of the 23 EVs that GM is working on for 2023.     The Impala will meet the ax earlier despite a recent stay of execution. Production is still set to close in January 2020. In the entire GM stable, Cadillac might soon be the only marque with sedans. The Buick LaCrosse has a date with death, and Groupe PSA won't supply Opels-as-Regals forever.  The Sonic hatchback should say goodbye at the end of 2020, a year before the seemingly eternal Spark is thought to die. Two years after that, according to one report, the Camaro will go back into cold storage, perhaps forever, and AN says an "expected redesign of the car in 2021 was reportedly canceled." Finally, let's give one final shout-out to the Chevrolet Cruze, a global nameplate, which in the United States alone outsells the Malibu, outsold the Camaro by a factor of three last year, and absolutely trounces the Impala, Sonic, and Spark. Even that couldn't get a stay of execution. In more uplifting news, everything's happening on the crossover and truck side in the next few years. The Chevy Bolt is due for a refresh next year, even though it has "become more important for self-driving ride-hailing fleets that GM Cruise plans to operate than for consumers." In 2021, the Bolt-based crossover should bow, first in China, then here. It's said to look like "a mix of the Bolt and Trax" in spy shots. Still waiting for a green light: a possible subcompact GMC crossover called Granite that might make it to market by 2023. The full-sized SUV triplets Tahoe, Suburban, and Yukon could show their new faces in 2020. The Silverado might get an updated interior in 2020 or 2021, while the Colorado and Canyon mid-sized pickups won't get attention until perhaps 2023.

Okay, so not exactly cars, but Bobcats - but still quite cool. You might remember that the National Corvette Museum had that little divot that needed to be filled in. Turns out the construction firm of Scott, Murphy & Daniel doing the work is using two remote-controlled Bobcats to fill the sinkhole with "manufactured sand," which in this case is crushed limestone. It appears that the Bobcat company has offered remote operation since at least 2007 via a wireless transmitter that works up to 1,500 feet away. So yes, that means two SMD employees stand on the edge of the pit and flick joystick levers for hours at a time, one in charge of a Bobcat with a roller-compactor attachment, the other in charge of a Bobcat with a bucket.
