GM 8-speed transmission lawsuit granted class action certification

A story on Autoblog about potentially faulty 8-speed automatic transmissions from General Motors in 2019 has, as of the day this was published, 166 comments, mostly from owners of cars and trucks who say they are experiencing "a hesitation, followed by a significant shake, shudder, jerk, clunk, or 'hard shift' when the vehicle's automatic transmission changes gears." At the time, lawyers were seeking statewide classes in at least six states. As of today, the Detroit Free Press reports that a judge has granted class action status to a lawsuit brought by 39 plaintiffs across 26 states covering the transmission issue. The lawsuit specifically applies to vehicles that are equipped with GM's 8L90 or 8L45 8-speed automatic transmissions made between 2015 and March 1, 2019. Both of these transmissions are similar units, the 8L45 being slightly lighter version used in fewer vehicles than the beefier 8L90, and are designed for front-engine, rear- or all-wheel drive applications. The lawsuit alleges that the erratic transmission behavior makes some vehicles unsafe to drive. Ted Leopold, partner at Cohen Milstein and the court-appointed lead counsel for the case, said in a statement, "General Motors knowingly sold over 800,000 eight-speed transmission vehicles, which they knew to be defective for years, and yet made the business decision not to tell its customers before purchase." He added, "Dealers were directed to tell the customers that harsh shifts were ‘normal' or ‘characteristic.Â’ Such decision making is both highly irresponsible and emblematic of what GM believes it can get away with." The vehicles included in the court order with potentially faulty transmissions includes: 2015-2019 Chevrolet Silverado 2017-2019 Chevrolet Colorado 2015-2019 Chevrolet Corvette 2016-2019 Chevrolet Camaro 2015-2019 Cadillac Escalade and Escalade ESV 2016-2019 Cadillac ATS, ATS-V, CTS, CT6, and CTS-V 2015-2019 GMC Sierra, Yukon, Yukon XL, and Yukon Denali XL 2017-2019 GMC Canyon Some additional details of the lawsuit can be found at the Cohen Milstein site, including claims that "since 2015, GM has issued thirteen versions of a “technical service bulletin,” or “TSB,” related to this shifting issue alone." The statement from Cohen Milstein says that a "second action regarding GM vehicles with 8L transmissions is also underway in Battle v. General Motors, LLC, 2:22-cv-108783.

A million insects lost their lives today. Boxelder bugs and mayflies making the ultimate sacrifice in Elkhart Lake, their carapaces no buffer against a rocketing rectangle of safety glass. Their bodies gorily streaking into spangles along the diamond-faceted face of the Cadillac CTS-V. Road America is a four-mile ribbon of pavement snaking its way through the emerald center of the country's northern heartland. Since the 1950s it's seen uncountable fields of diverse racing machinery rocket over its hills and around its 14 corners. I would imagine that on those occasions the tramping of onlookers and hubbub of vehicles, both competitive and commonplace, would dissuade a great number of our six-legged friends from making their way onto the track. But today it's just me turning laps. Inconceivably just one journalist, driving the baddest roadgoing Cadillac ever made, on one of the loveliest circuits America has ever carved out. So big-winged bugs made it out to me in a vast array and a tragic sum, and I drilled through them oblivious to anything but one of the greatest days of driving I've ever had. Cadillac ELR production has stopped, Chevy Bolt coming in Oct.

It looks like General Motors' Cadillac ELR extended-range plug-in is out as the automaker prepares to go all in on the Chevrolet Bolt electric vehicle. The Caddy officially stopped production in February, Hybrid Cars says, citing Cadillac Product Communications Manager David Caldwell. There is still a "small quantity" of the coupe at dealerships, but this take on mashing up "luxury coupe" with "green vehicle" has about run its course. Caldwell and Johan de Nysschen, president of General Motors' Cadillac division, had already confirmed earlier this year that the ELR, which was first available as a 2014 model, wouldn't have any further generations, though weren't specific on when production would stop. The ELR uses an upgraded version of the first-generation Volt's powertrain to move the 4,000-pound beast, and while the Volt is now in its second generation (and this year's sales have more than doubled from a year earlier as a result), the ELR never received a similar upgrade. The ELR sold just 357 units through April. As a result, the ELR sold just 357 units through April, down almost nine percent from a year earlier. In all of last year, 1,024 ELRs were sold, compared to more than 15,000 units for the Chevy Volt, and that's after the ELR's price was cut by about $9,000 last April. The car also got about a 25-percent increase in power, but that didn't seem to do the trick when it came to boosting demand, even with the available $7,500 federal tax credit. Meanwhile, Hybrid Cars is reporting that the 2017 Bolt, which will feature a single-charge range of about 200 miles and is expected to retail for about $35,000, is likely to start production at GM's Orion Assembly Plant in October.
