4 automakers agree to $553M settlement of Takata airbag claims

WASHINGTON (Reuters) - Four automakers agreed to a $553 million settlement to address class-action economic loss claims covering owners of nearly 16 million vehicles with potentially defective Takata airbag inflators, according to court documents filed on Thursday. Toyota's share of the settlement costs is $278.5 million, followed by BMW at $131 million, Mazda at $76 million and Subaru at $68 million. According to a press release from Plaintiffs' Committee for Takata Airbag Product Liability Litigation, the funds for the settlement are aimed at getting more cars with faulty airbags fixed. At the time of writing, Toyota had the greatest recall completion percentage of 31.89 percent followed by Subaru with 31.37 percent. Mazda has completed repairs on 18.16 percent of affected cars, and BMW brings up the rear with 16.48 percent completion. Some settlement funds will go to an outreach campaign to increase awareness, while other funds will be used to reimburse people for any costs accrued to get their cars fixed. These costs can include rental cars, child care, lost wages, or any other reasonable costs associated with bringing in a vehicle for repairs. Furthermore, a customer support program will be funded with settlement money to handle any additional repairs or adjustments that could become necessary in the 75,000 miles following the airbag replacement. Lawsuits against Honda, Ford and Nissan have not been settled, lawyers said. Takata inflators, which can explode with excessive force and unleash metal shrapnel inside cars and trucks, are blamed for at least 16 deaths and more than 180 injuries worldwide. The safety defect has prompted recalls worldwide of about 100 million inflators by more than a dozen major automakers. Mini might build a sedan because it's running out of shapes

Rumors suggest we could soon see a Mini with a trunk to haul your junk. Autocar cites unnamed insiders who claim the sedan is part of the brand's plan for upmarket growth. There's even a possibility the new model could use the Riley moniker in reference to the Elf (pictured above) from the 1960s, which was a Mini with a tiny trunk. The Mini sedan would use BMW's front-wheel-drive platform that underpins the X1 and Clubman and might share the wheelbase and frontend styling with the Clubman as well, according to Autocar. Mini's execs think the four-door would perform especially well in North America and China, where there's less demand for hatchbacks. Ralph Mahler, vice president of Mini's product management, hinted at the possibility of the four-door to Autocar. "For example, in Asia and the US, the sedan segment is very big. This is very interesting to us, of course," he said. Mahler admits that many people don't know about the Mini-based vehicles with trunks from the '60s, like the Riley Elf, so it would be hard to market the new model on that heritage. This could be the perfect time to add a Mini sedan to the lineup, and it might not be a completely new idea for the brand under its BMW stewardship; a rumor from 2012 shows that Mini's bosses considered a four-door at least once before. The company launched new versions of its Hardtop, Convertible, and Clubman, and even added four-door and all-wheel-drive versions of the Hardtop to further blur the lines between that car, the Clubman, and the Countryman. The next-generation Countryman crossover should debut later this year, and the brand reportedly cancelled the Superleggera Vision roadster and Rocketman compact, as Mini has chosen to go big with its new models and its lineup breadth. There are only so many versions of a hatchback a company can make, and the short-lived Mini Coupe wasn't exactly a huge success. If Mini is going to try a new body style, a sedan actually makes some sense, even if we'll probably prefer the look and practicality of the hatches. Related Video:

Permanent erection lawsuit against BMW thrown out

The California man who claimed that he suffered from a 20-month erection after a four-hour ride on his BMW K1100RS motorcycle (similar model pictured above) has had his case dismissed. It seems the court found his claims too hard to believe.
Henry Wolf filed a product liability lawsuit against BMW and seatmaker Corbin-Pacific in the California Superior Court in April 2012 after he claimed a motorcycle ride in September 2010 caused a long-term case of priapism from the "ridge-like" saddle design. He asked for compensation for lost wages, medical expenses and emotional distress from both companies.
Nearly two years later, according to Visor Down, Judge James J. McBride decided that the case didn't have enough supporting evidence. A urologist testified that the plaintiff had priapism, but the court rejected the testimony of a neurologist who claimed the motorcycle's vibration caused the disorder. The defendants presented testimony from the bike's former and subsequent owners. Corbin-Pacific CEO Mike Corbin also spoke in the company's defense.
