BMW to pay $1.6M, rehire workers in discrimination settlement

A BMW subsidiary is on the hook for $1.6 million and must rehire workers as part of a settlement for a race discrimination lawsuit with the US Equal Employment Opportunity Commission. A change in BMW Manufacturing's criminal background check policy at the Spartanburg, SC, factory disproportionately affected African American workers, according to the EEOC, and it cost many people their jobs. The automaker has since changed the policy. According to Automotive News, the suit stemmed from BMW switching logistics contractors at the plant in 2008. As a result, 645 existing workers had to submit revised criminal background checks to keep their jobs. About 100 people didn't meet the new guidelines, according to the EEOC, and they lost their jobs. Around 80 percent of those affected were African American. According to the government agency's complaint, the altered procedures only took into account the category of a crime, not factors like when it occurred or whether the infraction was a misdemeanor or felony. With the settlement accepted by US District Court, BMW must offer work to the affected employees in this case and as many as 90 African American applicants that the contractor didn't hire because of the rules. The automaker also must offer training in the proper manner for criminal background checks. While there's nothing inherently wrong with investigating workers, "when a criminal background screen results in the disproportionate exclusion of African-Americans from job opportunities, the employer must evaluate whether the policy is job related and consistent with a business necessity," P. BMW X7 rumored to get BMW's best interior, 130,000-euro price

Spanish outlet Motor.es has some info on the coming BMW X7, the sport activity vehicle that will take the Munich brand to the penultimate SUV segment. Unnamed sources said BMW has been working on both the X7 and the future Rolls-Royce all-terrain vehicle for almost two years, and that in BMW guise it will ride on the CLAR (CLuster ARchitecture) platform that will make an appearance later this year under the new 7 Series. The Rolls-Royce, on the other hand, will get its own aluminum spaceframe. The two vehicles will share components, though, which are now being tested. Running gear and engines will borrow from the X5 and X6 tool chests, with rear- and all-wheel-drive configurations mooted and engines ranging from the TwinPower 3.0-liter six-cylinder to an uprated version of the 6.0-liter V12 in the 760iL. The 4.4-liter V8 is mentioned as the middle child and perhaps the base for an X7 M, should one be made. A plug-in hybrid offering could swipe the unit from the X5 xDrive40e PHEV, good for 55MPGe in that current application. The interior, we're told, will be the nicest seen on any BMW, said to surpass that of the new 7 Series. We'll have to wait two years to find out how close all of that is to the mark, but the tidbit that might need some salt sprinkled on it right now is the predicted price: Motor.es says 130,000 euros in Europe, to start. That's not the first time a sky-high price has been predicted, but a leap that far beyond the six-figure mark would readjust all of our expectations for the vehicle when an X5 cost 53,700 euros in France and an X6 costs 70,900 euros. Other outlets predict US pricing to start from around $60,000; the X5 costs $53,900 here, the X6 is $59,600.

Permanent erection lawsuit against BMW thrown out

The California man who claimed that he suffered from a 20-month erection after a four-hour ride on his BMW K1100RS motorcycle (similar model pictured above) has had his case dismissed. It seems the court found his claims too hard to believe.
Henry Wolf filed a product liability lawsuit against BMW and seatmaker Corbin-Pacific in the California Superior Court in April 2012 after he claimed a motorcycle ride in September 2010 caused a long-term case of priapism from the "ridge-like" saddle design. He asked for compensation for lost wages, medical expenses and emotional distress from both companies.
Nearly two years later, according to Visor Down, Judge James J. McBride decided that the case didn't have enough supporting evidence. A urologist testified that the plaintiff had priapism, but the court rejected the testimony of a neurologist who claimed the motorcycle's vibration caused the disorder. The defendants presented testimony from the bike's former and subsequent owners. Corbin-Pacific CEO Mike Corbin also spoke in the company's defense.
