NHTSA slaps BMW with $40M fine for slow Mini recall

BMW is on the hook for a $40-million fine after the National Highway Traffic Safety Administration slapped the automaker over not recalling Minis that failed to meet minimum side-impact crash standards. The civil penalty from NHTSA concerns 2014 and 2015 Mini Cooper hatchback models that "failed a crash test designed to determine whether the vehicle met crash-protection minimums," the government agency said in a press release issued this week. An October 2014 test revealed the first problem, and the Mini was subsequently retested in July, only to fail again and finally prompt a recall of more than 30,000 cars. But according to NHTSA's investigation that was opened in October, BMW waited too long to issue a recall after it knew the cars did not meet standards and bring them into compliance with more energy-absorbing materials installed by Mini dealers. This is the second time NHTSA slapped BMW with a major penalty, following a $3-million fine back in 2012 failing to report recalls of its cars and motorcycles. "For the second time in three years, BMW has been penalized for failing to meet that obligation," NHTSA Administrator Mark Rosekind said in the release. "The company must take this opportunity to reform its procedures and its culture to put safety where it belongs: at the top of its priority list." In a separate release issued this week, BMW Group said it, "is committed to further improving its recall processes to better serve its customers," and that the company, "respects the role of NHTSA and looks forward to working with them to develop solutions for the future." Under terms of a Consent Order issued to BMW, the company acknowledges that it violated requirements to issue a timely recall of vehicles that did not comply with minimum crash protection standards, to notify owners of recalls in a timely fashion, and to provide accurate information about its recalls to NHTSA. NHTSA imposed a $3 million civil penalty to BMW in 2012 for similar violations.

Guess which brand's not on a top 10 list of best EVs (hint: it's Tesla)

Few surprises lurk in Autotrader’s list of its 10 best electric vehicles of 2023, but there is one that stands out: no Teslas. There's Hyundais and Kias, Porsches and Fords, a BMW and a Nissan. But Â… no Teslas. Although many of us admit to being over-Musked and tired of reading about him, the lack of a Tesla model on a selection of the 10 most desirable current EVs is conspicuous by its absence. Asked about this particular omission, we received this rather vague response from Autotrader spokesperson Brenna Buehler at Cox Automotive: “Tesla models were included in consideration but didnÂ’t get sufficiently high scores by the Editorial team to qualify for the top 10.” At least some Tesla offerings appeared to meet all the requirements set by the website. The manufacturers must offer 2023 model year vehicles, and they have to be sold in at least 15 states. Check. Only pure EVs were allowed on the list; there are no hybrids, plug-in hybrids or hydrogen fuel-cell vehicles. Check. The base manufacturer's suggested retail price must be less than $100,000. Check. Let the debates begin. Moving on, it should be noted that two Genesis models, a G80 sedan and GV 60 SUV, are listed, along with a Lucid Air midsize sedan, the Rivian R1T pickup, and the Porsche Taycan. Did BMW really win the luxury car sales race?

As anyone who follows our monthly By The Numbers series already knows, the luxury car sales race in the United States was close all of last year as BMW, Lexus and Mercedes-Benz seesawed up and down for sales supremacy. At the end of the year, it was BMW on top of the standings with 346,023 total sales. Or was it? According to data released by Polk, comparing the actual number of vehicles registered between the three top luxury players in the US paints a slightly different picture. Polk's data suggests that only 335,259 BMWs were registered in 2015, compared to 340,392 Lexus models. Why the disparity? It's all a matter of timing. Actual end consumers buy new cars, in almost all cases, from a franchised dealer. BMW delivered 346,023 vehicles in 2015, but only 335,259 of them were registered by their new owners. Presumably, those 11,000 BMWs did (or will) end up registered in the driveways of consumers, but they hadn't before January 1, 2016. Lexus General Manager Jeff Bracken wrote in an email to Automotive News, "Luxury sales leadership as measured by vehicle registrations is important to Lexus as it represents actual consumers engaging directly with our dealers." Of course, it goes without saying that we'll be paying keen attention to the 2016 luxury car sales race as it unfolds. If it's anything like it was in 2015, it'll come down to the wire, and even then may not be entirely clear.
