BMW slapped with discrimination suit by EEOC

According to a report from CNNMoney, BMW has been hit with a lawsuit from the US Equal Employment Opportunity Commission after revised criminal background check policies resulted in the dismissal of 88 contractors, 70 of whom (that's about 80 percent) were black. A total of 645 contractors were required to submit to background checks at BMW's facility in Spartanburg, South Carolina after BMW switched contract companies at its plant.
Though the 88 persons who were not rehired by the new contractor all had criminal records, that may not necessarily be a legal way to screen applicants, as the EEOC counters: "BMW's policy has no time limit with regard to convictions. The policy is a blanket exclusion without any individualized assessment of the nature and gravity of the crimes, the ages of the convictions, or the nature of the claimants' respective positions."
BMW's actions were in violation of the Civic Rights Act of 1964, according to the EEOC, because they utilized "a criminal conviction policy that disproportionately screened out African-Americans." A recent bulletin offering guidance from the EEOC on the Civil Rights Act can be found here, but the EEOC's stance on the issue has been the same for years: "Since issuing its first written policy guidance in the 1980s regarding the use of arrest and conviction records in employment decisions, the EEOC has advised employers that under certain circumstances, their use of that information to deny employment opportunities could be at odds with Title VII."

Frankfurt Motor Show Notes: Why Jaguar decided to build an SUV

It was inevitable. Jaguar had to make an SUV, and that notion became reality this week with the debut of the F-Pace, an all-wheel-drive five-seater that will launch in the United States next spring. Some purists may cringe. But in an era when Porsche, Bentley, Lamborghini, Rolls-Royce, Aston Martin, and other traditional luxury brands are all building or (planning to build) SUVs, Jaguar had to evolve. While it seems like a leap for Jaguar to make an SUV, longtime design director Ian Callum said it's been in the works for years. "The first time I was asked the question was when I arrived 16 years ago," he said. So in 1999 (and probably well before that), Jaguar was already thinking SUV. What took so long? "It wasn't a priority," Callum said. Jaguar was concentrating on fixing its existing lineup, which was pockmarked with holes and poorly selling products, like the X-Type. Along the way, Jaguar and sister brand Land Rover were sold by Ford to Indian conglomerate Tata Motors. Flash forward several years, and Jaguar and Land Rover are both experiencing a resurgence in the United States and around the world. Jaguar's lineup is flush with the E-Type's modern successor, the F-Type, plus a new version of the XF. The XJ received a 2016 freshening, and the smaller XE sedan is on the way. Jaguar put its house in order as other factors conspired to make a crossover timely. Fuel prices stayed relatively low, and consumers in the US and China remained steadfast in their love for utility vehicles of all stripes. Making a Jaguar SUV became a priority. "The world was telling us in no uncertain terms this is what they wanted," Callum said. "Not to be in the sector would be a little naive for the sake of purity." Jaguar proved its intent two years ago when it revealed the C-X17 crossover concept at Frankfurt, and the final production model is close to the prototype's striking looks. "I thought we managed to maintain that spirit," Callum said. It's a true Jaguar, with cues from the F-Type, 1968 XJ, and other famous models. Who would have thought Jaguar would make an SUV? "I certainly didn't," Callum admitted. But the F-Pace is here. If Callum is okay with it, purists can be, too. More stick shift models added to MINI's 2024 lineup

While automotive journalists have called in recent years for their industry and consumers to “save the manuals," their campaigns for manual transmissions have fallen mostly on deaf ears. Except at MINI. No surprise. The take rate for a stick shift in a Mini is said to be 18% to 20%, and in John Cooper Works models, it's more like 40%. The figure for the auto industry in general is 1.4%, meaning that driving stick is all but a lost art — unless you're driving a Mini, or say, a VW GTI or Golf R. In a presentation this week detailing the changes and specifications of MINIs for the 2024 model year, one revelation stands out: additional hardtop and convertible models that can be ordered with stick shifts. Specifically, the list includes MINI Cooper convertible, the Cooper S ragtop, the Cooper four-door hardtop and four-door Cooper S. Production of those cars is scheduled to begin in March. In November, MINI USA, which is part of the BMW organization, announced the return of manuals in its Cooper, Cooper S and John Cooper Works 2-door hardtops. Here's a pricing breakdown: Regarding other updates announced, MINI will continue to offer “special” editions — Untamed, Untold and Resolute — that launched a year ago and received additional enhancements in November that included new body colors, interior upholsteries, and engine variants. These three editions can be had on the respective models equipped with the Iconic Trim. MINI also says it will reintroduce the base Classic Trim to all Hardtop, Clubman, and Countryman models, and the Signature Trim will feature MINI Navigation as included equipment, with Advanced Real Time Traffic Information built in. In December, the company introduced a pair of tricked-out convertibles named the "Seaside Edition" that can be optioned in Nanuq White or Caribbean Aqua colors. Those models should be hitting dealers right about now, MINI says.
