Feds greenlight BMW X5 diesel sales for 2016 [UPDATE]

Update: The EPA also confirmed that the 2016 X5 diesel passed the tests in a statement: "EPA and the California Air Resources Board certified BMW's 2016 diesel X5. EPA is performing additional screening when it conducts confirmatory emissions tests before issuing a certificate. Our screening tests found no evidence of a defeat device in the 2016 BMW X5, concluding our certification review." The 2016 BMW X5 xDrive35d is the latest diesel model to pass rigorous emissions tests by the Environmental Protection Agency and prove that it doesn't circumvent regulations with a defeat device. The luxury SUV can now go on sale to customers, and BMW spokesman Hector Arellano-Belloc confirms to Autoblog the first of them should arrive at dealers around late January. The automaker previously delayed production of the new model at the Spartanburg plant until the EPA completed certification. Following Volkswagen's emissions cheating, the EPA, California Air Resources Board, and Environment Canada began stricter testing for diesel vehicles to ensure that they met regulations. The first models to get the additional scrutiny were the 2016 Chevrolet Colorado and GMC Canyon with the Duramax engine, and they passed with no problems. According to Reuters, the X5 diesel was the only other non-VW from the 2016 model year that the agencies needed to certify with this more rigorous evaluation. The 2016 X5 xDrive 35d starts at $58,695 after the $995 destination charge. A 3.0-liter six-cylinder engine sends 255 horsepower and 413 pound-feet of torque through an eight-speed automatic to the all-wheel drive system. BMW claims that the vehicle can reach 60 miles per hour in 6.5 seconds, and the 2015 model carries an EPA fuel economy rating of 24 miles per gallon city, 31 mpg highway, and 27 mpg combined. As good as the BMW 7 Series may be – and trust us when we say it is very good indeed – it just can't compete with the marketplace juggernaut that is the Mercedes-Benz S-Class, at least not where global sales are concerned. And with sales come profits, especially at the six-digit price point many of these high-end luxury cars sell for. Put simply, Mercedes is cashing in on the S-Class, and BMW wants a bigger piece of that pie. It comes as little surprise, then, that Autocar reports BMW is currently considering two proposals for a new 8 Series that would slot just above its current 7 Series. One option is the currently-en-vogue four-door coupe. The other option is a more traditional two-door coupe, likely with a cabriolet option. The last time we heard such rumors, BMW was dismissing them back in 2013. Whichever way BMW decides to take its 8 Series plans, Autocar suggests that a concept vehicle ought to hit the show circuit in sometime in 2018, with a production model following in 2020. The car would be based on the underpinnings of the latest 7 Series, with a price considerably less than the Rolls-Royce Ghost (which also falls under the BMW umbrella). Considering BMW's penchant for multiple model variants, we won't be surprised if all three options get the green light, with a Gran Coupe version standing as the flagship. With the 6 Series Gran Coupe currently priced just below the 7 Series (and at a hefty premium to a comparable 5 Series four-door), an 8 Series would likely brush up against $100,000 for a base price. That might not take much out of S-Class sales, but it would make some tidy profits for BMW. Related Video:

BMW slapped with discrimination suit by EEOC

According to a report from CNNMoney, BMW has been hit with a lawsuit from the US Equal Employment Opportunity Commission after revised criminal background check policies resulted in the dismissal of 88 contractors, 70 of whom (that's about 80 percent) were black. A total of 645 contractors were required to submit to background checks at BMW's facility in Spartanburg, South Carolina after BMW switched contract companies at its plant.
Though the 88 persons who were not rehired by the new contractor all had criminal records, that may not necessarily be a legal way to screen applicants, as the EEOC counters: "BMW's policy has no time limit with regard to convictions. The policy is a blanket exclusion without any individualized assessment of the nature and gravity of the crimes, the ages of the convictions, or the nature of the claimants' respective positions."
BMW's actions were in violation of the Civic Rights Act of 1964, according to the EEOC, because they utilized "a criminal conviction policy that disproportionately screened out African-Americans." A recent bulletin offering guidance from the EEOC on the Civil Rights Act can be found here, but the EEOC's stance on the issue has been the same for years: "Since issuing its first written policy guidance in the 1980s regarding the use of arrest and conviction records in employment decisions, the EEOC has advised employers that under certain circumstances, their use of that information to deny employment opportunities could be at odds with Title VII."
