NHTSA gives okay for three automakers to skirt tire-related recalls

BMW, Honda, and Mercedes-Benz are all going to avoid small recalls, after the National Highway Traffic Safety Administration issued petitions for "findings of inconsequential noncompliance" to the three manufacturers, according to Tire Business. Basically, the petitions allow the brands to avoid recalls for some very, very minor issues.
BMW had tire placards on 364 X6 M CUVs that stated the car could only handle four passengers, when in reality it had room for three in the back. Actual plausibility of fitting three real humans in the slope-roofed Bimmer aside, the Munich-based manufacturer argued it was inconsequential, as the placards were correct regardless of the number of passengers.
Honda's case focused on 212 2011 and 2012 Acura TSX sedans equipped with 18-inch wheels. The TPMS systems on these cars were set for 17-inch wheels, rather than the larger hoops, but even with the lower settings, the tires maintain adequate load capacity.

The US-spec 2016 BMW 7 Series is gorged with enough technology for it to qualify as a finalist in our Technology of the Year award. But not all of the tricky bits found on the European-spec car are offered Stateside, like the automated Park Assistant Plus that lets a driver remotely move the car into and out of a parking space using the touchscreen keyfob. The reason is Section S5.3 of Standard No. 114 of the Federal Motor Vehicle Safety Standards, which dictates that "the service brake... be depressed before the transmission can be shifted out of park.'" Since Park Assistant Plus is remote controlled, the brake pedal isn't pressed when the car shifts from Park into a gear. Automobile reports that the National Highway Traffic Safety Administration has conceded the law is too vague, and granted BMW's request for an exemption to bring the convenience feature to the US. NHTSA said that the point of the law was to have brake actuation during the transition from Park to a forward or reverse gear, not to insist that someone actually presses the brake pedal. BMW said it plans to bring Park Assistant Plus to the US soon, but the carmaker doesn't yet have a firm timeline for the move. To us that seems like a small yet significant victory as the marketplace fills up with cars that have abilities beyond the current laws to manage. Now if we could just get that whole FMVSS headlight issues worked out and enjoy some of that tasty Matrix and MultiBeam lighting. Environmental group accuses BMW, JLR of link to deforestation in Paraguay

ASUNCION, Paraguay — Environmental group Earthsight said on Wednesday it has linked some of Europe's largest carmakers to the deforestation of the Chaco, a dry forest region of Paraguay home to jaguars and one of the last uncontacted indigenous groups in the world. The group said in a report that livestock companies have illegally logged lands of the Ayoreo Totobiegosode indigenous ethnic group, some of whose members live in voluntary isolation. The livestock skin is used in leather upholstery of luxury vehicles sold by high-end European auto brands including BMW, Jaguar and Land Rover, the group said. UK-based Earthsight said it had made covert visits to tanneries that bragged about supplying the raw material to the luxury car brands. "BMW is using hides sourced from two slaughterhouses processing cows from ranches responsible for illegal [logging] in the Ayoreo Totobiegosode's forests. Jaguar Land Rover didn't dispute sourcing from a Paraguayan tannery that processes hides from another slaughterhouse doing the same," the report said. Jaguar Land Rover said in a statement to Reuters it had found no evidence to verify Earthsight's claims. It said its European suppliers assured sustainability. "We continue  our drive for further transparency and, in this case, the leather supplier in Europe verifies with each raw material supplier that no rural property that directly supplies it is involved in illegal deforestation," the automaker said. BMW did not respond to a request for comment on the Earthsight investigation. Paraguay exports about 50,000 tons of wet-blue leather (tanned, but not dried, dyed or finished) a year, and almost two-thirds of those shipments are bound for Europe, according to the report. Automakers say that leather is a byproduct of the far larger meat industry and high-end cars constitute a comparatively small market niche. But indigenous leaders say deforestation driven by growth in beef and leather exports is encroaching on their territory and destroying their way of life. "As deforestation advances with extensive cattle ranching, they are being imprisoned, they are disappearing," Taguide Picanerai, a spokesman for the Ayoreo community in the Alto Paraguay department, northwest of Asuncion, told Reuters.
