Did BMW drag its feet on Mini recall?

The National Highway Traffic Safety Administration is opening an investigation into BMW's reporting of a recall for 30,456 examples of the 2014-2015 Mini Cooper Hardtop, Cooper S, and the 2015 John Cooper Works. According to the government, "it appears from a review of NHTSA's databases that BMW may have failed to submit recall communications to NHTSA in a timely manner." The automaker issued the recall in July because crash tests showed the models didn't meet side impact requirements for passengers in the back seat. While there were no reported injuries at the time, the company decided to install energy-absorbing material in the space between the rear interior panels and the exterior. However, NHTSA has decided to investigate whether this campaign should have started much earlier, given the evidence the company had. According to the government's report, the Cooper Hardtop failed side-impact tests in 2014, although one of these tests was five-miles-per-hour faster than the Federal Motor Vehicle Safety Standard. The agency claims: "In January 2015 BMW verbally committed that it would conduct a service campaign to add padding to the rear side panels of MY 2015 Mini 2 Door Hardtop Cooper models. However, BMW did not initiate the service campaign and failed to inform NHTSA of its failure to do so." A subsequent crash test of an example with this fix showed it to make the vehicle compliant with the rules. Mini spokesperson Mariella Kapsaskis told Autoblog: "Regarding the NHTSA audit query, BMW Group is evaluating the request and will respond to NHTSA as appropriate." How many automakers have loaded up how much ammo and taken how many shots at the BMW 3 Series? Yet here we are, decades on and at least a decade away from the 3 Series' halcyon days, waiting for someone to give the sport sedan something beyond a flesh wound. In this most recent episode of Head 2 Head, Johnny Lieberman goes to Spain to figure out if the Jaguar XE is the sedan to do it. Here the champion wears the guise of the 335i M Sport, powered by a 3.0-liter, turbocharged, inline-six with a square 300 horsepower and 300 pound-feet of torque run through a ZF eight-speed transmission. After a short time behind the wheel Lieberman quotes from a familiar hagiography, saying it's evident "just how great this car is and why it defines the segment." The all-aluminum challenger from Jaguar comes in XES trim, meaning a 3.0-liter, supercharged V6 with 340 hp and 332 lb-ft. It uses the same eight-speed transmission as the BMW, but with different programming. According to the specs in the video, some of which are manufacturer estimates, the Jaguar is heavier, more expensive, and much thirstier at the pump. Away from the spreadsheet, Lieberman holds that the XE looks better and feels more special inside. In case you're wondering, the comparo was done before MT could get its mitts on the 320-hp BMW 340i. Lieberman says the English company spent its money on the XE suspension and it shows, but there have been other efforts from other automakers with excellent dynamic chops that weren't enough to threaten the BMW. BMW 2 Series Active Tourer corners surprisingly flat on 'Ring

With seven seats and front-wheel drive, you might not expect the upcoming long-wheelbase version of the BMW 2 Series Active Tourer to live up to the Ultimate Driving Machine reputation that BMW has fostered over the years. But the latest spy clip from the Nürburgring suggests otherwise.
The Bavarian automaker has apparently been testing its new people mover on the Nordschleife, getting it ready to join the growing 2 Series family. And though it's wearing heavy camouflage, we can clearly see from the video below that it's cornering impressively flat - which bodes well for those who'll need to transport their expanding family but aren't prepared to give up on handling.
