NHTSA slaps BMW with $40M fine for slow Mini recall

BMW is on the hook for a $40-million fine after the National Highway Traffic Safety Administration slapped the automaker over not recalling Minis that failed to meet minimum side-impact crash standards. The civil penalty from NHTSA concerns 2014 and 2015 Mini Cooper hatchback models that "failed a crash test designed to determine whether the vehicle met crash-protection minimums," the government agency said in a press release issued this week. An October 2014 test revealed the first problem, and the Mini was subsequently retested in July, only to fail again and finally prompt a recall of more than 30,000 cars. But according to NHTSA's investigation that was opened in October, BMW waited too long to issue a recall after it knew the cars did not meet standards and bring them into compliance with more energy-absorbing materials installed by Mini dealers. This is the second time NHTSA slapped BMW with a major penalty, following a $3-million fine back in 2012 failing to report recalls of its cars and motorcycles. "For the second time in three years, BMW has been penalized for failing to meet that obligation," NHTSA Administrator Mark Rosekind said in the release. "The company must take this opportunity to reform its procedures and its culture to put safety where it belongs: at the top of its priority list." In a separate release issued this week, BMW Group said it, "is committed to further improving its recall processes to better serve its customers," and that the company, "respects the role of NHTSA and looks forward to working with them to develop solutions for the future." National Highway Traffic Safety Administration fines BMW $40 million for failing to meet safety requirements Fine is auto company's second since 2012 WASHINGTON – The U.S. Department of Transportation's National Highway Traffic Safety Administration has imposed a $40 million civil penalty and a series of performance requirements to automaker BMW North America for a series of violations of the Motor Vehicle Safety Act and NHTSA regulations. Under terms of a Consent Order issued to BMW, the company acknowledges that it violated requirements to issue a timely recall of vehicles that did not comply with minimum crash protection standards, to notify owners of recalls in a timely fashion, and to provide accurate information about its recalls to NHTSA. NHTSA imposed a $3 million civil penalty to BMW in 2012 for similar violations.

Hyundai, Kia, Genesis and Subaru clean up in IIHS 2018 safety ratings

Hyundai, its partner Kia and its Genesis division are the big winners in the latest vehicle safety ratings from the Insurance Institute for Highway Safety, accounting for six of the 15 models that earned the Top Safety Pick+ awards for 2018. Subaru was right behind with four, Mercedes-Benz had two, and Toyota, BMW and Ford each had one. Another 47 vehicles earned the Top Safety Pick designation, where Toyota had 10 vehicle models, with Hyundai recognized for nine models. All but one of the seven vehicles in Subaru's lineup, the BRZ, qualified for one of the awards. IIHS strengthened the criteria for the Top Safety Pick+ award for 2018 to require headlights to earn a "good" rating — an "acceptable" rating was previously enough to notch the "plus" award — and good or acceptable passenger-side protection in the small overlap front crash, which replicates a crash involving just the front corner of a vehicle. It also required vehicles to have acceptable or good headlights for the first time to earn a Top Safety Pick award. Most of winners for both awards qualified on the basis of optional upgrades. IIHS in October began evaluating the passenger side of vehicles in its small overlap front crash test after it said it became clear that automakers were neglecting that side of the vehicle as they focused on improving driver-side protections. IIHS first began conducting driver-side small overlap crashes in 2012. It began measuring both how well low and high beams illuminated the road and the amount of glare they produce for oncoming vehicles as part of its ratings in 2016. The Top Safety Pick+ winners are listed below. The list doesn't include any minivans, pickups or minicars, which don't appear on either list of awardees. 2016 BMW 435i ZHP Edition Coupe Quick Spin [w/video]

BMW will make a total of 100 ZHP 435i coupes for 2016. This is not one of them. Nope, it's their predecessor, what the company calls a "replica," based on a 2015 car. Think of it as Car Zero. Bimmer nerds (the ones who correct you if you call their car a "Beemer") will remember the ZHP package from the E46 3 Series. An internal option code that became insider lingo and a must-have for enthusiasts. They're still sought after today. Built from 2003 to 2006, the original ZHPs included a power boost (to 235 hp), a modified suspension, an M-Tech II body kit, and a unique shifter and shift knob. The new ZHP has a considerably longer list of equipment. It builds on a 435i coupe with the M Sport package and either a manual or automatic transmission. Additions begin with the new-for-2016 Track Handling package – 18" wheels, M Sport brakes, the Adaptive M Suspension, and Variable Sport Steering. To that BMW adds an M Performance limited-slip differential, M Performance exhaust, the M Performance Aerodynamics package, and the M Performance Engine Kit; horsepower goes from 300 to 335, torque jumps to 332 lb-ft for automatic cars or 317 on manuals. Yeah, it's a lot of stuff, but nothing you can't order on a car for yourself. So the process that let BMW make this replica so easily also contributes to a lack of specialness. All of the equipment is available either from the factory or through BMW's VIA personalization program. VIA components are spec'd at the time of ordering and then installed at port when the car lands in the US. BMW hasn't announced pricing yet, but we have a hunch a full-on ZHP will come in slightly lower than a car optioned a la carte (though we don't know, since BMW didn't tell us how much our car cost). The 4 Series we reviewed had all the ZHP equipment save the wheels and tires. All 2016 ZHPs will get v-spoke wheels finished in Orbit Grey and wrapped in Michelin Pilot Super Sport tires; the car we drove had a different 18-inch wheel design and Bridgestone Potenza S001 rubber. Driving Notes The 435i already has too much power. The M engine kit provides more of it. You may not be surprised to learn that we also enjoy chocolate-covered chocolate. Perhaps the saving grace of the questionable output bump, and the most transformative part of this package, is the mechanical limited-slip. Even without the grippier tires it's supposed to come with, the near-ZHP put it all to the ground smoothly and predictably.
