Lawsuit reveals gruesome details of Takata airbag victim's death

The accident was minor. The aftermath was horrific. Carlos Solis was waiting to turn left into a Houston-area apartment complex on January 28 when oncoming traffic struck the front-left corner of his 2002 Honda Accord, pictured above. He was stopped, according to a police report of the accident. The other car traveled at under 30 miles per hour. He should have walked away from the fender-bender. Instead, the 35-year-old married man was killed when a defective airbag exploded and sent a large piece of metal shrapnel into his neck, his estate's lawyers allege in a lawsuit filed Thursday in Harris County, Texas. He bled to death while his younger brother and an 11-year-old cousin tried to save him. Solis is one of at least six motorists killed by defective airbags made by Takata, a global automotive supplier. He may also be a posthumous poster child for federal legislation introduced earlier this week that would ensure car owners receive more timely information about safety recalls. Currently, federal law does not require car dealers to tell prospective buyers about open recalls on used cars or whether defects have been repaired. Legislation introduced by Sen. Ed Markey (D-Mass.) and Sen. Richard Blumenthal (D-Conn.) wouldn't require that directly of dealerships, but it would mandate that car owners be notified of recalls when they apply for registration and at the time of registration renewal. "Important recall notices can get bogged down with legalese, and busy consumers can miss a life-saving update," Blumenthal said. "This legislation provides a common-sense avenue to ensure every driver is reminded and encouraged to make the necessary repairs." Such a law may have prevented Solis' death. Although his '02 Accord had been recalled in late 2011, his wife and lawyers say he had no knowledge of the recall when he bought the car used from All Star Auto Sales in 2014, nor did he know of the dangerous flaw when he set out to visit his parents on Jan. 18. Only one month earlier, Congress held hearings on Takata and Honda's long-standing inaction related to the defective airbags. Documents showed both companies were aware of problems with the airbags as early as 2004, and a report in The New York Times detailed secret airbag tests, the results of which alarmed Takata engineers. Yet the company withheld the information from federal safety administrators.

Honda fined $70 million for failing to report deaths, injuries

The federal agency charged with keeping US motorists safe announced Thursday it has fined Honda $70 million for failing to report death and injury data in a timely manner. Honda failed to report 1,729 incidents involving death or injury over an 11-year period, according to National Highway Traffic Safety Administration officials. Federal law requires automakers to report deaths, injuries and certain warranty claims. Officials said Thursday that information could have been used to spot trends in automotive defects and potentially save lives. Transportation Secretary Anthony Foxx said it is possible the Department of Justice could conduct a criminal investigation into the failures, but it was not immediately known whether the Justice Department would pursue such charges. NHTSA officials still don't know much about the 1,729 incidents of death or injury that were missing from the Early Warning Reporting records, because in some cases, they still haven't been reported. Mark Rosekind, the agency's new administrator, said Honda is still in the process of sending investigators the missing information. "Our first task will be to review that, and determine actual deaths and injuries," he said. "That data is in the process of coming to us and being processed right now." The $70 million is the largest civil penalty levied against an automaker in history, officials said. It actually consists of two $35 million penalties, the maximum allowed by statute for a single TREAD Act violation. In this case, NHTSA broke the fine into separate violations, one for the missing deaths and injury information and one for the company's failure to report certain warranty-claim information. Honda reached an agreement with the federal government in late December, in which it accepted additional regulatory oversight and third-party audits that will ensure reporting is properly completed in the future. If you're looking for the cars with the best gas mileage, your best bets are hybrids and EVs, and with the latter, then it's a case of energy efficiency considering the lack of gasoline. But maybe you don't like the idea of an electrified vehicle. Maybe you're concerned about more complicated powertrains or new technologies. Maybe you're put off by the extra up-front cost of those vehicles. So what's the best way to get good fuel economy, without batteries? Well, we've pulled together the 10 most fuel-efficient cars that only run on gasoline. Best Gas Mileage Cars for 2024: 2021 Mitsubishi Mirage and Mirage G4 View 27 Photos Mitsubishi Mirage: 39 mpg combined When you can't be electrified, you need to achieve high efficiency with other strategies. In the case of the Mitsubishi Mirage, those come from low weight (just 2,084 pounds) and low power (just 78 horsepower). That's how the Mirage manages to top the list at 39 mpg combined. In the city it gets 36 mpg, and on the highway it manages 43, both of which are tops in this list, too. That just applies to the hatchback, though. The sedan would technically be second on the list with 37 mpg combined, but we're generally lumping together body styles. The other big draw of the Mirage is that it's incredibly cheap and has a long warranty. The base hatchback starts at $18,110 with destination, making it one of the cheapest cars on the road. And it has a 10-year/100,000-mile powertrain warranty. So if you're looking for maximum frugality above literally all else, it's hard to top the Mirage. Honda Civic: 36 mpg combined While the Mirage wins technically, it makes many compromises to achieve its price and fuel economy. The rest of the list provides far better balancing of economy with being quality modern automobiles. And coming in second is the Honda Civic sedan (pictured at the top of this article) in EX trim with the turbocharged 1.5-liter four-cylinder and CVT. This variant manages 33 mpg in the city, 42 on the highway and 36 combined. Going to the Touring trim drops fuel economy to 34 combined, and the 2.0-liter non-turbo engine gets between 33 and 35. The most efficient hatchback gets 35 mpg combined. The hatch is even available with a manual transmission, but it's also the least efficient (31 mpg). Then there's the Si and Type R, but with much more power and handling upgrades, they're basically different models. Regardless, almost every version of the Civic is quite frugal.
